RE: The tariff classification of a pillow cover from China

Dear Ms. Tovar:

In your letter dated January 21, 2013 you requested a classification ruling on behalf of Revman International.

The submitted sample, Style “Metallic Circles,” is a pillow cover. The pillow cover is made from a cotton knit fabric laminated with a layer of compact polyurethane. The cover measures 16 inches square. It features a zippered opening.

In your letter you suggest the classification of the item under 3924.90.56, HTSUS, as a household article of plastic. The pillow cover is considered to be constructed of a textile fabric rather than a Chapter 39 plastic.

The applicable subheading for the pillow cover will be 6304.91.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: knitted or crocheted… of cotton. The duty rate will be 5.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
